Website Contract - Terms and Conditions
Services Provided
Website clients agree to pay the flat $250 design fee. Addison Multimedia reserves the right to collect this fee on a schedule determined on a case-by-case basis. This design fee covers 1 (one) template design per website. Addison Multimedia reserves the right to modify prices and plans, and will not change or increase prices of any plans currently in use by Addison Multimedia customers without prior notice. If no plan is selected, or specific plans are no longer offered, website services will be billed at the hourly rate. Website services by Addison Multimedia may include the following: Technical website training, technical support by phone or email, website maintenance, content revisions, module setup, and backup recovery (if available). The following services are currently billed under the hourly rate unless otherwise specified by an agreement or special offer by Addison Multimedia: additional graphic design, moving or copying of page content, new pages, additional templates, and supplemental domain registrations and setup.
Client Amends and Revisions
Addison Multimedia website clients will be allowed to revise the initial design of their website, under the paid $250 design fee, for a limit of 1-month (30 days) after work has officially begun on the design. Any graphic design or template modifications requested after the one month period will be billed at the current hourly rate.
Client Delays
Addison Multimedia will attempt to collect data and content from a customer as needed to complete a website. If an attempt to collect content or data for a client's website is not responded to within a one-month time period, the customer's website will be published and considered complete in it's current state and Addison Multimedia will be entitled to the full amount ($250) for the design fee. In addition, if payment for any month of service is not received within 45 days, the customer agrees to be billed for outstanding service time at the current hourly rate. Addison Multimedia also reserves the legal right to claim compensation from defaulting clients for any services billed by third parties to Addison Multimedia for the maintenance and publishing of a clients website.
Ownership
Clients are legally responsible for content, graphics, and any specific instruction given to Addison Multimedia to complete a design. Upon completion, payment, and final approval, clients retain any legal rights to designs rendered by Addison Multimedia and the client agrees to allow Addison Multimedia to use any completed design for it's own portfolio, advertising, and promotional purposes.
Limitation of Liability
Customers using this website to transmit credit card information to Addison Multimedia assume all legal responsibility for said transmission and agree that Addison Multimedia is not to be held responsible for any fraud, theft, or misuse of unrightfully obtained financial information stored on Weebly servers. In addition, Addison Multimedia is not responsible for the unauthorized use of copyrighted materials if such materials are supplied by the client or instructed by the client for use without disclosing the true legal rights to usage. In the case that Addison Multimedia is accused of breach of contract, copyright infringement, or any other lawsuits pertaining to a work or work(s) rendered as a service for a client, the client claims full responsibility for the final product. The client agrees to full legal responsibility for consequential damages and traveling to other States, Provinces or countries in defense of any such case.
Client and/or Third Party Page Modifications
Addison Multimedia is not responsible for any damage done to the site by the client or any other party if attempts are made to modify it. If such damage occurs Addison Multimedia will attempt a backup restore, or repair. If the site is deemed unrecoverable, the client agrees to pay the current hourly rate ($50/hr.) for services to repair the site.
Payment Terms
Services requiring an hourly compensation rate will be billed to the client electronically via email. The client understands that no paper bill will be mailed, and the client is responsible for giving a valid email address. Payment terms for billed invoices are listed on the invoice, and payments can be made online on this website. Addison Multimedia reserves the right to calculate and bill late fees as necessary for accounts that are overdue. Reoccurring credit card payments are set up through PayPal. Website clients agree to allow the appropriate service charges to their credit card under the agreed upon terms at purchase. If the appropriate payments cannot be collected, services will be discontinued and any legal action necessary will be taken to recover money owed to Addison Multimedia for services rendered.
